Blinkdrama (BlinkDrama, “we”, “our”), provides a Platform (as defined below) for studios and publishers to distribute and monetize various video works (a “Work” or “Works”). These TERMS OF USE, together with all documents referred to herein and all other operating rules, policies and procedures that BlinkDrama may publish from time to time, govern BlinkDrama’s relationship with users (“users”, “you”) of the BlinkDrama platform located at the website www.BlinkDrama.life, including all sub-domains and associated websites (collectively, the “Website”), the BlinkDrama mobile application(s), including iPhone and Android mobile applications (“Apps”), any and all other platforms on which content is accessed, published, or distributed, and all associated services, features, or content made available through any of the foregoing (“Services”) (together, the “Platform”).

If You reside in the United States of America, You unconditionally accept these terms and promise to strictly abide by them; this constitutes a legally binding agreement between You and ApexScope Horizon Media Inc., a U.S. registered company, regarding Your use of the BlinkDrama Services. Any reference to “BlinkDrama” in the Terms will then always refer to “ApexScope Horizon Media Inc.”. You acknowledge and agree that these terms shall be governed by U.S. law in their entirety, which applies to contracts entered into and performed within U.S.A, without regard to any conflict of laws principle.

If You reside in countries other than the United States of America, You unconditionally accept these terms and promise to strictly abide by them; this constitutes a legally binding agreement between You and Atlas Ventures Culture & Technology Limited, a Hong Kong SAR registered company, regarding Your use of the BlinkDrama Services. Any reference to “BlinkDrama” in the Terms will then always refer to “Atlas Ventures Culture & Technology Limited”. You acknowledge and agree that these terms shall be governed by Hong Kong law in their entirety, which applies to contracts entered into and performed within Hong Kong, without regard to any conflict of laws principle.

If you do not agree to these terms, please do not use the platform. In that case, you will not be able to access, view, or use the platform for any purpose.

BlinkDrama may add, change, discontinue, remove, or suspend any other Content posted on this Site, including Works described or depicted on the Site, temporarily or permanently, at any time, without notice and without liability.

BlinkDrama may contain links or embedded material to third-party content, which BlinkDrama has not reviewed. This includes, without limitation, other websites and third-party services, provided for the convenience of visitors, for advertising purposes, or for other similar functions related to BlinkDrama’s business.

BlinkDrama's linking or embedding to third-party content does not imply an advertisement or endorsement of any good, service, product, or otherwise, provided by such third party. BlinkDrama is not responsible for any third-party content linked or embedded to or from the Platform. It expressly disclaims, without limitation, any responsibility for any third-party content, the accuracy of any information found on any third-party website, or the quality of products or services provided by or advertised on such third-party website.

1. Eligibility

To use this platform, you must be at least 13 years of age. By agreeing to these terms, you hereby declare and warrant: (a) You meet the age requirement of 13 years or older; (b) You have not had your service suspended or terminated; (c) Your registration and platform usage comply with all applicable laws and regulations. If you are using this service on behalf of an institution, organization, or enterprise, you must declare and guarantee that you have the authority to bind the organization to these terms and agree to accept their constraints under the organization's name.

2. User permissions

2.1 Subject to your full compliance with the terms and our lawful authority to grant the relevant rights, BlinkDrama hereby grants you a non-exclusive, non-divisible, and non-transferable intellectual property license, which is strictly limited to accessing the works, utilizing the platform, and other purposes explicitly specified herein.

2.2 To avoid any ambiguity, this clause expressly excludes the transfer of intellectual property rights of our party or any third party to you. All ownership, rights and interests pertaining to such property shall remain vested in the original rights holder.

3. Registration and Account

3.1 To use platform-specific features, you must first register a BlinkDrama account (hereinafter referred to as "Account"). You confirm that all information submitted during registration and any additional details provided in your account profile must be truthful and accurate, and you commit to maintaining continuous updates.

3.2 Your account is unique and exclusively personal. You are responsible for maintaining account and password security, restricting access permissions, and agreeing to assume full responsibility for all purchases and other operations conducted under your account.

3.3 You have the right to cancel your account. Please note that after cancellation, you will lose access to all or part of the platform's features.

3.4 We reserve the right to deactivate, suspend, or terminate your account at any time for any reason, including but not limited to non-compliance with any provision herein.

4. Restrict user behavior

4.1 Unless expressly prohibited by applicable law, you shall not: (a) reproduce, distribute, publicly display, or publicly perform this Service; (b) modify this Service in any way; or (c) interfere with or bypass any function of this Service (including security mechanisms or access control systems). If applicable laws prohibit your use of this Service, you shall not use it.

4.2 Except for the BlinkDrama accepted method, you are prohibited from modifying the platform in any way or accessing it through other technologies or means, including but not limited to the use of bots, web crawlers, or other automated access methods.

5. Payment Terms

5.1 Using certain features of the platform or service may incur fees. Before payment, you may review and confirm the fee details. All fees are USD-denominated and non-refundable.

5.2 BlinkDrama reserves the final right to determine service pricing. BlinkDrama will make reasonable efforts to ensure timely updates of pricing information published on the website. We recommend regular visits to the official website for the latest price updates.

5.3 BlinkDrama will charge fees for the payment method you specified at checkout. You authorize BlinkDrama to collect the full amount for your order via this payment method, along with any fees incurred under these terms or any service tiers published by the company. If paying with a credit card, BlinkDrama may request pre-authorization from your credit card account prior to purchase to verify the card's validity and sufficient funds/credit limit to cover the purchase amount. Payment processing services are provided by third-party platforms used by the exchange (e.g., Apple In-App Purchases, Google Play Store, Adyen, etc.).

5.4 All procurement transactions may involve taxes and other fees, including but not limited to foreign exchange handling fees or price differences caused by regional variations (such as exchange rate fluctuations). We may calculate the applicable taxes based on the information provided through your account or materials submitted during procurement.

5.5 Your membership is valid for a pre-set duration, with the exact length to be determined during subscription. Depending on your choice, the membership may automatically renew monthly until termination. To access service content, you must use a device with platform support and internet connectivity, and provide the latest valid payment method (payment options may be updated at any time). If you select automatic renewal, please cancel your membership at least 24 hours before renewal takes effect to avoid additional charges. Subscription plans are available directly from us. Note that different plans may include special discounts or additional terms, which will be explained to you during registration or through other communication channels.

5.6 If You reside in the United States of America, Your acceptance of this payment merchant service provided by ApexScope Horizon Media Inc.

6. Disclaimers

6.1 This platform is provided in the form of "current status", "available status", and "all defects present", and is intended solely for the purposes described herein. The risks associated with the use of the platform are solely borne by you. You shall exercise prudence and apply your best judgment during use.

6.2 BlinkDrama does not guarantee stable, interference-free operation or zero error rates when using this platform, its associated features/services, or during data transmission and display processes. It also does not ensure the platform's immunity against security threats such as viruses or worms. You acknowledge and agree that: all operational risks associated with content acquisition through this platform or related websites/platforms shall be borne solely by you. Any financial losses (including affected computer systems and mobile devices) or data loss resulting from platform usage or content downloads shall be entirely your responsibility.

6.3 BlinkDrama makes no warranties regarding the availability, delivery timelines, performance, pricing, or punctuality of any works or other intellectual property content appearing on the platform. This includes, but is not limited to: no guarantee that future episodes will be promptly released by screenwriters or publishers, that works will remain continuously available on the platform, or that prices for works and services will remain stable.

6.4 BlinkDrama shall not be liable for deletion or storage failure of comments or other information submitted to the platform. We expressly promise not to store or retain any submitted comments. You are responsible for backing up all comments uploaded to the platform.

6.5 You acknowledge and agree that BlinkDrama shall not be liable for any service disruption caused by force majeure events, including but not limited to natural disasters, fires, explosions, sabotage, terrorist attacks, extreme weather, national emergencies, riots, wars, labor disputes, supplier failures, material shortages, data breaches, or any government directives/requests, as well as suspensions of existing services pursuant to state/federal laws and regulations.

7. Limitation of Liability

7.1 Despite any contrary provisions in this Agreement, BlinkDrama shall not be liable for any direct, indirect, special, incidental, consequential, exemplary, extra-contractual, or punitive damages arising from the Platform or these Terms, regardless of applicable legal theories (including but not limited to contract law, tort law, personal injury, property loss, negligence liability, warranty liability, or strict liability), whether BlinkDrama had prior knowledge of such damages or their likelihood, and even if other remedies fail to achieve their core purpose. Should you have any dissatisfaction with the Platform or these Terms, or believe BlinkDrama has violated them, your sole and exclusive remedy is to cease using the Platform. This limitation of liability clause constitutes a fundamental agreement between both parties.

7.2 Regardless of other provisions in this Agreement, if any part of this Liability Limitation Clause is declared invalid or unenforceable for any reason, the liability under the BlinkDrama Agreement arising from breach of this Clause and/or your use of the Platform shall not exceed USD 500.00 for all claimed amounts.

8. Indemnification

8.1 You shall be solely responsible for your use of this platform and bear full liability to BlinkDrama and its executives, directors, employees, consultants, affiliates, subsidiaries, and agencies (collectively referred to as "BlinkDrama Entities") for all claims, liabilities, losses, damages, and expenses (including reasonable attorney fees and related costs) arising from: (a) your access to, use of, or suspected use of the platform; (b) your violation of any terms herein, referenced warranties, or applicable laws and regulations; (c) infringement of third-party rights (including intellectual property rights, publicity rights, confidentiality rights, property rights, or privacy rights); or (d) any disputes with third parties. The Company reserves the right to independently cover costs and provide exclusive legal defense and control over matters for which you are liable (without limiting your compensation obligations). In such cases, you must cooperate with the Company's legal defense efforts regarding the claims.

8.2 BlinkDrama reserves the exclusive right to represent itself in defense of claims for which compensation is entitled. In such cases, you shall cooperate with BlinkDrama's litigation proceedings at your own expense in a timely and reasonable manner.

9. Promotion activities

In addition to these terms, BlinkDrama may include specific rules in promotional activities offered through the platform or in other forms. By participating in promotional activities, you agree to and are bound by these additional terms, with detailed rules provided upon launch. BlinkDrama recommends carefully reviewing all rules before participating in any promotional activities. In case of conflicts between promotional terms and these terms, the specific promotional rules shall take precedence.

10. Dispute Resolution

You and BlinkDrama agree that any disputes, claims, or controversies arising from these Terms or your relationship with BlinkDrama (whether based on contract, tort, fraud, misrepresentation, or other legal theories, regardless of whether the dispute occurred during or after the termination of these Terms) shall be resolved through compulsory arbitration. Arbitration disputes between the parties shall be subject to binding arbitration awards issued by the Hong Kong International Arbitration Centre ("HKIAC") in accordance with the Hong Kong International Arbitration Centre Administrative Arbitration Rules in effect at the time of submission of the arbitration notice.

11. Notices

All legal notices arising from the terms of this agreement must be submitted in writing and emailed to BlinkDrama's corporate address: service@blinkdrama.life. By using this platform, you hereby agree that any legal notices sent electronically by BlinkDrama shall be legally binding. You are obligated to maintain up-to-date contact information in your account. We shall not be liable for any issues resulting from failure to update account details or contact information in a timely manner.
